Libby's lawyers trying to eliminate Fitz

It looks as if Libby's lawyers are attempting to invalidate Fitzgerald's authority and get him removed from the Plame case.
This from SFGate:

"In a 24-page filing in federal court, the legal team for I. Lewis "Scooter" Libby said Fitzgerald and the former Justice Department official who appointed him, James Comey, are changing the broad mandate the prosecutor was handed to probe the leak in the Valerie Plame affair."  <snip>

"The defense attorneys say assignment of unsupervised and undirected power to Fitzgerald requires that he be relieved of his duties in the investigation and that all actions he has taken be voided. Fitzgerald's appointment violates federal law, the defense attorneys say, because his investigation was not supervised by the attorney general. They say only Congress can approve such an arrangement." <snip>

"Similarly, despite the fact that as recently as August 2004 Mr. Fitzgerald characterized himself as `the functional equivalent of the attorney general in this matter,' he now insists in response to Mr. Libby's challenge that he always `understood' he had no authority to expand his jurisdiction and that he was required to follow certain substantive department policies," the court papers added.

This from the WaPo:

"Several legal experts said yesterday that the Libby defense team was making a valiant and appropriate effort to defend its client, but said they doubted that the central argument for dismissing the charges would gain traction with the court.

"I think it's a nice try, but I don't give it much chance of success," said Scott Fredericksen, an associate independent counsel during the Reagan administration who helped investigate scandals at the Department of Housing and Urban Development."

Comey's clarification of Fitzgerald's broad authority below, August, 05.

SUBJECT: Delegation of Authority
In the attached correspondence to Patrick J. Fitzgerald, United States Attorney for the Northern District of Illinois, dated December 30, 2003, and Feburary 6, 2004, I delegated to Mr. Fitzgerald all of the authority of the Attorney General with respect to the Department's investigation into the alleged unauthorized disclosure of a Central Intelligence Agency employee's identity. By virtue of the authority vested in me as Deputy Attorney General under the law, including 28 C.F.R. § 0.15(a), I delegate to you all of my authority as Acting Attorney General with respect to that investigation and Mr. Fitzgerald's service as Special Counsel, as delineated in that correspondence. This delegation to you in no way retracts or modifies the scope of the prior delegations of authority to Mr. Fitzgerald. http://www.usdoj.gov/...

This is scary. I hope this thing goes away. I've wondered for some while when they would start on Fitz. Looks like it's Showtime.

Does anyone think they can get it done?
